Please read these Terms of Service (“Terms”) carefully before using the El Boton mobile application (the “Service”) operated by El Boton LLC (“us,” “we,” or “our”).
Acceptance of Terms
By downloading, installing, or using El Boton, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the Service. These Terms apply to all users of the Service.
Description of Service
El Boton is a community safety application that allows users to send emergency alerts to their designated circles of trusted contacts. The Service enables users to share their location, communicate with responders, and coordinate assistance during emergencies. The Service is designed to supplement, not replace, official emergency services.
Not a Replacement for Emergency Services
EL BOTON IS NOT A SUBSTITUTE FOR PROFESSIONAL EMERGENCY SERVICES. In any emergency situation where you or someone else is in immediate danger, you should always call your local emergency number (such as 911 in the United States) first. El Boton is designed to help coordinate responses from your personal network and should be used as a supplement to, not a replacement for, official emergency services. We make no guarantees about response times or the availability of responders.
User Responsibilities
By using El Boton, you agree to:
- Provide accurate and complete information when creating your account
- Use the Service only for legitimate safety and emergency purposes
- Not send false alerts or misuse the emergency features
- Not use the Service to harass, threaten, or harm others
- Keep your account credentials secure and confidential
- Comply with all applicable local, state, and federal laws
Account Termination
We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to: sending false alerts, harassing other users, violating these Terms, or engaging in any activity that we determine to be harmful to the Service or its users. Upon termination, your right to use the Service will immediately cease.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EL BOTON LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE; FAILURE OF RESPONDERS TO ARRIVE OR RESPOND; DELAYS IN NOTIFICATION DELIVERY; OR ANY UNAUTHORIZED ACCESS TO YOUR ACCOUNT. THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
